    These are just four of the dozens of portraits that appear inside "The Afro-American Press and its Editors," compiled in 1891 by I. Garland Penn, former editor of "The Recorder" in Lynchburg. Penn records the history of the Black press and also includes a directory.

    The 2020 version of RegMap has been released and can be downloaded for free (hard copy is also complimentary). I love using this map of informal rulemaking with my leg-reg students.

    Here's one for the patent nerds, among others - the briefs for Carver v. Hyde, 41 U.S. (16 Pet.) 513 (1842) have not been previously known, but has them in the Justice Baldwin papers, along with his argument notes - PDF here:

    Man, would it really have been that hard to have the two IP cases on the same day? Lots of people will be at both. Although less good for AU having separate events.

    So I don't mean to offer this as a legal opinion, and I recognize there are contrary arguments. But I figured I'd put this out there and see what people think.

    I will note that there's a long history of allowances for limited publication to establish copyright - EG the "copyright performance" under UK law that has written about. And under 1909 law there was a difference between "investative" and "divestative" publication.

    But if you don't actually give the work to the public, I can't see how you're publishing it. I'm not arguing that it has to be the best possible version or available indefinitely, but to be published it can't be mutilated and must be available to the public in a ordinary way.

    Under US copyright law, publication is "a dedication to the public" of the creative work. In other words, it's saying "I made this, go enjoy it." In return for creators giving the public their work, the copyright statute enables them to protect and profit from their work.

    My intuition, and one shared by many IP scholars I've talked to, is that this may not. Note that I'm not actually an expert on EU law, and thus this is based mostly on my knowledge of American copyright law.

    In essence, is uploading a track to youtube, with noise added that makes listening difficult, and making the video inaccessible a few hours later, a "publication" or "communication" under EU law? Uploading a video to youtube in most cases would qualify, but...

    As background these were in the courthouse until the 1930s, when these two volumes were donated to the Library of Congress. A few other volumes were at the Court a while longer, and ended up at in Waltham, MA. CC

    I somehow missed them (as did others), but I "found" the pre-1831 Rhode Island copyright records - had them in their manuscript division all along, just cataloged separately: . I'll add them to the list soon.

    This isn't being publicized much as far as I can tell, but has put up a database of Circuit Court of Appeals Briefs from 1950-1980 - includes lots of cases that are frequently taught and cited. Worth being aware of:
