It’s unclear. Also he has no legal basis, just a capricious wish, as far as I can tell and that’s what multiple attorneys and legal scholars, including law profs, told me—all this because he seems to have some plans, not legal rights.

It’s amazing though, if I had been someone without resources he might’ve been able to bully me into moving in the middle of a pandemic without any legal basis whatsoever. Expat dude. People are having different pandemics.

And without resources, no representation. And that is exactly why 90% of tenants don't have attorneys to represent them and why the vast majority lose their case - even if they have defenses.

Indeed. North Carolina is a very landlord friendly state—and my landlord still lost. But without proper legal representation or advice, it might not have worked out that way. And now he’s appealing.

Heh. I have a mid-January court date and we’re already in district court. He lost previous round and appealed. I have a valid lease and I’m paying the rent—of course. Landlord thinks laws don’t apply to him, as far as I can tell.

I sat and listened to the other cases, and the lower courts were respecting the CDC order. Yeay! I’ll update people on what happens next. It may have a fair housing angle. (Long story, DM if you want).
