I'd say the big picture is complicated because there will be marginal cases. However, I don't believe the Jones case is complicated because it's way over the line. Banning him is a no-brainer.

I'd be curious to read your take on these platforms using allegations of hate speech to control this type of content. Such allegations reveal political stance and are therefore notoriously contestable.

Regardless of the free speech question, platforms have no obligation to publish all legal speech. They’ve explicitly chosen to become editors thru algorithmic promotion & filtering of content. That further makes them responsible for content in ways an agnostic platform wouldn’t.

I think they would claim just the opposite. That they are NOT responsible for the content others post. This actually might make them more liable in the future if they don’t take stuff down. Really a no win position.

So let’s extend this logically. If these platforms can ban speech of type X, what happens when type X creates their own platform and continues putting out their stuff. Can Comcast, ATT, Spectrum and other net backbone companies deny type X’s platform access for distribution??
