In the military the president controls it, BUT congress controls enlisted officers. They appoint them and remove rank and not even the President can touch them. This ensures he can’t stack it with followers for a coup. So, Congress can control parts of the executive branch.

That means they should just creat something like the Congressional Bureau of Investigation that does nothing but investigate the executive branch and file Congressional Indictments. They might not have arrest powers, but they can investigate and expose crime in public hearings.

Then they should pass a law that the CBI does not need a warrant to access any records any other branch has. They would be staffed with people with clearance and answering to Congress, and warrants only apply to the gov accessing a citizen.

Final step would be to say that since Congress is representing states that the CBI has this power over state officials and LEO as well. There’s no state’s rights issues since, again, this is the state’s elected official accessing state records.

To make it really interesting they should add to the charter that the CBI’s investigations are made public if there’s a hearing, or even just make it publix after. Sealed and secret investigations and courts is why they have this problem, so theyr best weapon is openness.
