    Thread. On Kavanaugh, by senior Judiciary Committee Democrat — this was obviously prepared by Leahy & staff prior to today’s hearing, but after Trump WH asserted executive privilege to keep Bush WH records secret.

    A President would be too busy (invading Iraq & watching the economy collapse & such) to be bothered with investigations as Clinton had been. Kavanaugh would now, if confirmed, deploy his conviction on behalf of a President who spends half his time watching TV and playing golf.

    9/11: a terrorist attack made possible by an indolent, careless President asleep at the switch. After it happened, Kavanaugh — having been hired by that same President — adopted the conviction that a President must not be questioned while in office.

    9/11, so Kavanaugh now says, was a seminal event for him, changing the very aggressive attitude he had taken, as part of the Starr inquest of Bill Clinton, about questions a President should have to answer in an investigation of suspected wrongdoing.

    ...without some federal agency telling them they can’t. The Federalist Society crowd from which Kavanaugh springs is lavishly funded by the very sources of concentrated wealth, so he takes their side. This irony isn’t the only one.

    Kavanaugh, in particular, would abandon the very sensible reasoning Scalia relied on as to agency discretion in how laws passed by Congress can be applied & enforced. Agencies are established by Congress to have subject matter expertise; Congress expects them to manage...

    Addendum: I can’t keep myself from noting some powerful ironies in the above. Kavanaugh takes a wildly broad view of the Chief Executive’s powers, but a very narrow one of Executive Branch agency authority.

    6. In terms of political messaging, an electorate anxious for some kind of check on Trump might be especially receptive to criticism of a “blank-check” Justice, and of the Republicans eager to put him on the Court to defend The Leader.

    5. thinks Kavanaugh’s view of Presidential power is more salient. His record suggests Kavanaugh would rule Constitutional almost anything the President who appointed him did. This could tempt recklessness in a President prone to it.

    4... they make it easier for Republican candidates to win elections. Some of these decisions have trashed precedent in this cause. Kavanaugh would do the same. I still think corruption of justice to serve party is a theme with kick, but takes a different view.

    2. I have thought the best message for Democrats involved the theme of corruption that applies to so much of the Republican Party. Specifically, GOP-appointed Justices on the Court now — who all gave the same assurances about respecting precedent & calling balls and strikes...

    <Thread> on Kavanaugh. I have taken the view that Senate Republicans will most likely unite in defense of Trump & Trump’s Supreme Court nominee. Kavanaugh will therefore be confirmed. Democrats had best come away from this fight with a clear political message.

    Brett Kavanaugh essentially just admitted that he'd overturn Chevron deference if he gets on the court. This is the biggest reason why big business is so pumped about him and has spent millions to get him confirmed. It would dramatically undermine the administrative state.
