“Taking over some patents” will make R&D go to zero. How will companies justify multi-year, multi-billion dollar R&D projects when the resulting patent might be “taken over”?

Are you arguing that increasing drug costs are primarily the government's fault? That's an interesting argument.
Defined guardrails (e.g. post-R&D profitability cap) can solve both problems.

The only R&D they are doing is on dick pill treatments anyway. They don't want to research cures. PrEP research was entirely publicly funded, and Gilead got all the profits.
