You ever seen someone translate das Sein as “the to be”? Sartre’s L’Être et le néant is always translated as “Being and Nothingness”.

Not sure I understand the problem. What exactly do you understand by the function of the gerund Being here, and what does it lack that is expressed by the infinitive Sein? Although it looks the same, it is not in a continuous form, but as noun gerund.

Does Sein and Être function similarly to the Spanish Ser? If so, I wouldn't place any misinterpretation down to the English language, but to an inability to read the English language correctly.
