Yeah this person is trying to say that the images don't, as if they're somehow divorced from the actions that create them. This is a common argument from people who want to legalize it.

I think you're exactly right because actually this is something that has been tested in the courts. Distributing those materials comes under the wing of the first amendment (if you're not creating but spreading it), but the courts decided that because the legalization of it (1/2)
