If the judge says, “this is dumb af shut up,” you can appeal all the way up to USSC, who usually also say, “this is dumb af shut up,” unless I totally misunderstand this system.

Don't know about American civil procedure, but generally "this is dumb" is supposed to be something reserved for examination on the merits (like a trial). ie, there is a formal process to saying something is dumb af, and you don't get to short circuit it.

there are lots of interlocutory requests that are decided on the merits, usually i am not giving legal advice, only legal information

hence cases brought to the ussc are less about delivering justice than they are about who does or does not have endless resources to hire lawyers

and i’m pretty sure a judge at the lowest level has a mechanism to hear an argument and go, “i will not hear your case, appeal if you must”

i think the opposing party can bring an application and say "there's no cause of action" but the threshold is high (varies by jurisdiction obvs.)

i’m saying if the judge is wrong you can appeal endlessly if you have endless resources
