Invalid patents *are* granted but (IMO) less and less. 1 reason: better search tech. New procedures also make patents easier to invalidate.
-
I see new software patents all the time that are patently (no pun intended) ridiculous. Not from the media, just normal browsing.
-
1. How closely did you read the *claims*? 2. Did you account for 'priority date'? It may be 10+ years ago. 2017 "Obvious" != 2007 obvious
-
I always read the claims closely. I know how to read patents.
-
If I came up with an idea as a junior dev working on jQuery in 2006, it seems inappropriate for someone to patent equiv claims in 2007-8
-
Agree. Patents are *presumed* valid but only finite resources available for examination and always possible something is missed...
-
... But unless you are being threatened with this patent, how does its existence affect you?
-
The existence of such a huge amount of bogus patents affects the environment I do my work in.

Most also don't understand legal scope of patent. Description, abstract, etc. may sound like 'patent on email' but *claims* way more specific
-
I read the whole patent. Lots of times the claims are on things like details of linked list impl, classic web app techniques.
-
What feels bad about software patents is that so many are things that many engineers would independently invent in the course of work.
-
No investment is required, and the lax patent examination makes it a land grab. Good patents have lower chance of being independently ...
-
invented by large number of people in the same short time frame (and probably require some non-trivial capital cost)
