      KC Johnson Retweeted Bernie Sanders

Sanders is a long way from his 2016 campaign position that the police should handle campus felonies.https://twitter.com/SenSanders/status/911248518249156610 …

This is a disgrace and a disservice to everyone who has worked to address sexual violence. Congress must act to undo this terrible decision. https://twitter.com/AP_Politics/status/911240729405607937 …

Illustrates how one-sided Dem position on campus due process has become. (Sanders, like colleagues, offers no specific criticisms of DOE.)

3/Problem: v. expensive system (schools pay neutral panelists, invr's, lawyers for those who can't afford). But at least tries to be fair.

2nd, & more impt: easy to avoid this concern (which I share): allow acc'd student to have a lawyer, and let lawyer ask Q's.

Ok, fair. I wonder why the new guidelines don't. For me (not deeply immersed), it generally seems problematic to have "cops or GTFO" policy

Depends on the punishment. Involving cops if the punishment is an apology seems not necessary. Not everyone in a position to deal w/ CJ sys

Two add'l options at that point: 1) Mary Koss (among others) has championed idea of restoratuve justice: http://www.skidmore.edu/campusrj/karp-vitae-files/media/The-lonely-quest-of-Mary-Koss.pdf …

Approach avoids worst effects of the current system (schools can wrongly brand student a rapist). Problem: forbidden by 1997 OCR guidance.

          2) Nothing in current debate envisions rollback of existing *non-adjudicatory* accommodations (academic, housing, counseling, medical, etc.)

The tone of the debate matters somewhat. You tend to be nuanced but whether someone believes "rapes are rare on campus" affects what happens

And I think it's relevant that "police or GTFO" is often used in the real world to say "I don't believe you if you won't go to the cops"

That doesn't mean we should brand people w/o due process (multiple cases show the folly of that) but CJ as rhetorical panacea has effects.

To state a (probably obvious) point, if we crack down on undocumented immigrants via cops, what now?

Correct. But the big difference here is we're already speaking of a felony in all 50 states.

Still: law enf. has tools to determine truth colleges don't. So if goal is->truth, then college system at least has to try to replicate.

Classic examples here are cases like Amherst (https://www.washingtonpost.com/opinions/campus-sexual-assault-policies-are-unfair-to-the-accused-this-case-shows-how/2017/08/16/2ab6781e-7de0-11e7-a669-b400c5c7e1cc_story.html?utm_term=.2f33e9c23054 …), where college's inability to subpoena ensured that truth was hidden.

Wholly on the undocumented point. (Also applies to other marginalized groups--esp trans students & in some cases students of color.)
