You are correct re: mechanics of licenses but overlook that FB is a huge litigation target. ASF isn't.

One could argue litigation playing field is tilted against FB (constant patent threats) and PATENTS is a small way to mitigate this risk

The litigation playing field is tilted against the little guy who can barely afford to get the patent, not the big companies with counsel.

Maybe. But if you don't have your own patent (& $ to sue) the React license will never be an issue. Nothing changes unless you sue FB 1st

Interesting to me that OSS advocates arguing against React license are actually arguing for stronger patent rights/more litigation

No, we're arguing that using an open source project as a back door to punish people for suing Facebook is wrong.

& that an appropriate license for React would also punish Facebook for initiating lawsuits (by revoking their right to other react patents)

What 'other React patents'? The only relevant patents are those belonging to FB. FB grants you rights which are revoked if you sue 1st

Look, I hear you t re: Apache. ASF's MO is OSS, community, etc., and their license reflects that. OSS/community is not what makes FB tick.

FB is a public co. and mitigating risk. The conspiracy theories ("FB wants to trap you with React and steal your IP!!") are a bit much.
