http://www.huffingtonpost.com/2014/12/12/antonin-scalia-constitution-torture_n_6316240.html … "Justice Antonin Scalia Says The Constitution Is Silent On Torture" 8th Amendment is a light suggestion apparently
@israelblog We don't like how "cruel and unusual" has been interpreted, but Scalia is saying there's nothing to interpret.

@wycats cruel & unusual punishment refers to a convicted criminal. Torture as a punishment is obviously towhead Scalia is talking about -
@israelblog the constitution bans punishments w/o conviction. I feel confident the founders did not intend this loophole. -
@wycats well that’s where we disagree. These are the same people who put slavery into the constitution -
@israelblog So your position is that the founders intended to allow torture without conviction? -
@wycats no my position is that the Constitution is not a moral beacon & not a source of ethical guidance -
@israelblog yes, I can see you want to argue about that, but I never argued the contrary.

@wycats my argument is that you are being overly generous about the constitution & Scalia perhaps being more honest on this point -
@israelblog In the 18th century, torture was common and applied as a punishment. The founders intentionally banned it. -
@wycats yes torture as a punishment! But that’s not what is being discussed here & that isn’t what Scalia is referring to -
@israelblog punishment w/o conviction was already taken care of via habeus corpus. -
@wycats and you are avoiding my point that habeus corpus does not apply to non-citizens which is justification for horrific detention system -
@israelblog Nobody restricted torture to non-citizens. And Scalia didn't say "non-citizen".
