The Fact is though, unfortunately, you have to have written permission from the owner of said footage. Without that, your argument is null/void.
The part that angers me, is that @TeamYouTube don't give you the option to remove the offending part before a strike.

Understand completely. In no way am I saying that I'm 100% entitled to use the footage but the footage could have been removed or part of the revenue could have gone to the owner. Yet, YouTube will side 100% with the claimant and shaft the video uploader. It's a lesson learnt.
