      An uninvited (like all my tweets!) excursus into how I (fallibly) try to approach commentary in the era of President Trump. I don't use the term Muslim Ban, though it is still in use, even by law professors of distinction, and even though as you regular readers know I am a big 1/

      critic of Trump in just about every aspect of immigration law and policy including this one, and always have been. But "Muslim Ban" refers to a policy Trump undeniably wanted and even promised during the campaign. It issued forth in a much more limited (still wrong!) policy 2/

      he put forth in an executive order that was then struck down by the courts and further revised into the policy ultimately upheld by the Supreme Court. One can argue that that policy, having its origins in a desire to ban Muslims as such from traveling to the US was therefore 3/

      unconstitutional. I think that's the wrong legal answer, but I agree that the policy's origins were in fear and anti-Muslim bias, and I can respect an argument that I am wrong about the law. But I don't like the tendency to call it a Muslim Ban, or to say "Trump called Nazis 4/

      very fine people" when these are demonstrably false claims. There are plenty of bits of real evidence that can make the case for Trump's racism and plenty of good arguments against his Travel Ban, and even though it's annoying to be careful where he is careless, it seems to me 5/

      important to be so precisely because he is not. Trump has operated with many legal constraints on him; indeed, in my view sometimes the courts have been too Trumpian in their hostility to him, and that's a danger we must guard against. Throwing around hyperbolic claims 6/

          to the effect that it's a lawless administration or that the separation of powers has ceased (it's been in trouble for some time and he hasn't helped, but by and large the system is intact) don't help the long term goal of living in a fact-based polity. Fin. 7/7
