    Let's not forget...Pew Research found that of the fewer than 50 million US adults on Twitter only 6% of those Twitter users account for 73% of tweets about national politics. That means fewer than 1% of Americans are frequently weighing in about politics on this platform.

    I think DOJ's still gonna be stuck on standing with this suit. The underlying merits are clear under current precedent. But to get there we've still gotta get proper parties.

    New lawsuit...same problem

    The trick here isn’t the merits; those were always going to be incredibly strong. The trick is how to get the right relief against the right defendants. A declaratory judgment against TX is a good start, but it’s not clear how a court can enjoin … everyone … from enforcing it.

    Errr...this is a real stretch on the state-action doctrine. DOJ arguing "private actors also may be found to function as agents or arms of the state itself and thus are bound by the Constitution."

    This is horrifying and everyone involved in misinforming women about risks to pregnancy and fertility should really go to hell.

    In Mississippi, at least eight pregnant women died of COVID-19 over the past four weeks. Dr. Dobbs says all eight were unvaccinated. Their babies survived after being delivered prematurely by c-section before their mothers' deaths.

    I may be the only person mourning this..but I am! I preferred the ordered questions from *every* justice. Will Justice Thomas continue asking questions? Probably not. Will we go back to advocate ping pong? Yep. And that's a loss for those who want to better understand the Court.

    New: Scotus will hold arguments in person this fall. Not open to public but audio of arguments will be streamed

    Yall. Casey overturned Roe 30 years ago for all intents and purposes. The Court said they were keeping the “essence” of Roe but replacing its reasoning and analysis.

    I mean…not really. But I get that “SCOTUS majority unsure of whether Ex Parte Young applies to state judges applying state law!!!!” didn’t have the same ring to it.

    Last night, the Supreme Court officially overturned five decades of settled law and permitted Texas' unconstitutional abortion ban to stand. Yes: They gutted Roe v. Wade without hearing arguments, in a one-paragraph, unsigned 5-4 opinion issued in the middle of the night.
