Wouldn't modifying LoW be **much** harder?
I agree re: POTUS relinquishing power, but there is precedent for Congress doing things that to some degree remove it (e.g. War Powers Resolution), and for setting out what *it* thinks would be legal guidelines (separate from LoW) — I see that more likely.

But either way I think LoW is the wrong approach — US is not going to codify terms that would make use of nuclear weapons impossible. Trying to make legal arguments for when justified could even make more easy to order it. I prefer a fleet of footballs to that..
