@Max_Fisher What Comey seems to be saying is that while some of the info lacked a classification label, it was still formally classified.

when I was in the business the rule was prior to getting a classification review,

you should protect the document at the highest potential classification level that you thought was in the document.

if there was any doubt, you assumed higher classification until an authorized derivative classifier could review it

I don't know if that is born classified but operator was supposed to have an understanding of the sensitive work

NDI needs to be classified by someone to have legal force. Restricted Data does not (officially). That is the diff.
