This is fucking nuts. FYI, stalking most victims is a misdemeanor in Washington state unless the stalker has been previously convicted of stalking the same victim.https://twitter.com/komonews/status/1321113424965758977 …

Specific carve-outs for domestic violence and DUIs. Other than that, misdemeanors would be essentially legal for anyone who can convince a judge they were experiencing symptoms of any mental illness when they committed the crime. For what it's worth, I've been diagnosed with both depression and anxiety in years past. I've experienced extreme financial insecurity and depended on friends for a roof over my head. I've never threatened physical harm to anyone. That's not how this works.

Ah, but lots of drug charges are felonies! IIRC it was back during the War on Drugs that this was made so, and lots of people complain about this being stupid (20-somethings caught with a bit of weed get a permanent FELON status following them around, and employers can ask).

what matters is what actually happens in these cases if DAs decide that a mental health defense will work, they won't even bother pressing charges if judges just ignore the existence of this category of defense, nothing changes the first one is concerning, and likely
