You see the problem here, right? If you generally can't be convicted of felony stalking without being convicted of misdemeanor stalking, and you can't be convicted of misdemeanor stalking if you're experiencing symptoms of *any* mental illness (yep, anxiety and depression too)...

Specific carve-outs for domestic violence and DUIs. Other than that, misdemeanors would be essentially legal for anyone who can convince a judge they were experiencing symptoms of any mental illness when they committed the crime. For what it's worth, I've been diagnosed with both depression and anxiety in years past. I've experienced extreme financial insecurity and depended on friends for a roof over my head. I've never threatened physical harm to anyone. That's not how this works.

We already make room for people whose mental illness is so severe and judgment-warping that they cannot determine right from wrong or understand the consequences of their actions. That's the appropriate standard. What's happened to us?
