If the recorded speech is taking place in a two-party consent state — including CA, where many Clubhouse members are located — the person recording can be prosecuted regardless of where they're physically located. The critical issue is whether or not CH convos are "confidential"
I honestly don't know which way that breaks with something like Clubhouse (as it currently operates). A very large number of people can be involved in those calls, but they all still have to be individually invited in order to participate

The standard is "reasonable expectation of privacy". The name of the app is "club house". I think you can win on that front.
