The problem isn't strong political tools for emergency response, the problem is the fundamental lack of respect for what they are. It's a big deal to suspend the right to assemble. Announcing at 40 days locked down that you still have no plan except more lockdown is unforgivable.

What we're supposed to be buying ourselves with an emergency toolkit that approaches the power of all-out martial law is the ability to deliver a rapid + flexible **short-term** response at whatever scale/scope makes the most sense. Not indefinite unannounced Martial Law Lite.

People will tell you that’s an exaggeration, but so long as we can’t hold a jury trial, and we can’t get most court orders made or enforced, and we can’t exercise fundamental civil rights, and the proposed duration is “as long as we feel like,” what else is it?

Precedent is based on quarantining a ship of 400 Italian immigrants in New Orleans which just sailed to Florida instead. We are a little out of scope on this.

And that was over a century ago, in an era when the Supreme Court essentially didn't enforce the Bill of Rights. It is by no means clear that modern-day appellate courts will consider indefinite, arbitrary "shelter in place" orders permissible.

relatedly, i've yet to hear a criticism of people protesting the lockdown that wouldn't apply equally to the sort of folks we call "heroes" or "martyrs" when they do it to protest government actions we *don't* like

The lockdown was supposed to deliver (1) a decrease in daily Covid cases
and (2) time to allow our country to get its sh%#$ in order and rapidly *Test and Trace* EVERYONE who needs it. Where are the Tests? Politicians need to be held to account -
In my neck of the woods, 3-4 day turn-around to get a Covid test result and need serious symptoms or verified exposure. If you had it, you probably gave it to friends&family by then. Meanwhile, in SKorea you can get a test result in a few hours if you have a tickle in your throat

even making plans for an exit strategy runs the risk of giving ground to the people that want to open up to soon and having the situation get away from you. the politics around all this needs to be kept in mind.

Is there any evidence of this happening with negative consequences, or is this just conjecture? It seems wrong to say "We can't do The Right Thing, bc someone may interpret it as a move towards The Wrong Thing".
