There is no way for biological sex to be anything other than binary due to how it’s used in the field of biology. It might be accurate to say that sex *characteristics* are not binary (eg intersex individuals) but sex itself is inherently so.
Yes. In bio, sex is descriptive of the complementary role of gametes, and there are two of them. Intersex phenotypes — the most common being micropenises, enlarged clitorises, etc. — are another issue. As I understand it, no known human has ever produced gametes for both sexes.

And yup, it's fine to describe phenotype wrt intersex as a "spectrum," but there's a bit of sleight of hand going on if you then assume more than two sexes. There's a reason "male" or "female" characteristics, "masculinizing" vs. "feminizing" hormones, etc. remain useful concepts

100%. To add to that, it’s not too unfair to describe a spectrum with 99.9% of the instantiations concentrated at one far end or the other as binary.
