A woman in SF was approached by a man wearing only hospital-issue bottoms, brandishing a knife & repeatedly yelling "who wants to get cut?" Police took the knife, but didn't arrest him, claiming this didn't constitute a "criminal threat." Sue. This. Unfortunately, case law is quite clear: police owe no duty to individual citizens or even the public at large. And prosecutors have discretion when it comes to bringing cases.

I'm not claiming the police are the ones to sue, nor do I think they're necessarily the ones that *should* be sued.

I mean that the police, if sued, would be immunized.

What if you tried getting someone to file a California Public Records Act Request (CGC 6250 et seq) with the SFPD? Ask for all police reports that include violence, or threats thereof, and then submit to news orgs?

This could be a good one. Every case SFPD identified the perp, and refused to refer to a DA.

I requested all records pertaining to and including all police reports describing something like the above in August & September of this year. I requested to view onsite to avoid getting hit with duplication fees. We'll see what happens, I guess?

What're they charging for that? I was given to understand FOIAs often cost 5-50 cents a page. Will you be able to create digital duplicates and share?

I don't know, I wanted to choose the lowest-friction option to get my foot in the door. I'm happy to spend a day there, or however long they'll let me review them. If I have to just take notes for reference, I'll file another request. No clue what volume of paper we're looking at
