I thought you may have been asking why they're free to do a thing that's not illegal. But you were really asking the policy question of 'should the thing be made illegal?' -- that's a fair question.

Honestly the question seems to have nothing to do with legality. A much better question is why is that information worth so much in the first place? How are they able to sell it at all? Did they mine a scarce resource? Do they have valuable expertise no one else has?
