What state is this in? My understanding is Federal Law dictate that they must be paid the minimum wage if they don’t earn it in tips

I've never heard of that law before, I was a waitress, the difference was never 'made up'. Not saying you're wrong, but my experience was I made $2.50 w/o tips. And I did food prep and bussing.

Can tell you right now that while I was waitressing at a total dive, there was zero chance in hell my manager was going to make up the difference. If I'd asked him to, he'd have accused me of underreporting and probably asked if I was the reason the register was short.

In the real world, the people who run these low-rent establishments know perfectly well that there are certain shifts during which their waitstaff won't make the minimum. If someone complains, compensate them for the $100-200 gap, fire them, and replace them with someone quieter.
