2)Under US law “sex” is the protected category. Until 2011, when the EEOC, an agency charged with enforcing disrcrimination laws, began interpreting “sex” as gender identity, courts and the EEOC held gender identity & sex were not the same. Since the EEOC turn, courts have split.

3) Supposedly nonpartisan, the EEOC is political. No more than 3 commissioners can be from one political party. Leaves 2 fr other. President appoints. But only 3 of 5 commissioners remain & no general counsel; Congress cannot agree on appts.
