  1. The rotating 4 first states: the 2 the last Dem most narrowly carried and the 2 the Dem most narrowly lost in the previous presidential election. Swing State Tuesday

At half time I’m watching a man in silver wearing a large Christian cross dancing with a women in red who is simulating sexual intercourse, and I realize I have no clue anymore about American culture.

I 100% agree and think should be considered for state & nat’l awards typically given to non student media (i.e. NC Press Association, Pulitzer, etc). While UNC leaders embarrass the university, DTH (+ other students & faculty) redeems it...

60th anniversary of a pivotal moment when four 18-19 year-old students in broke open the next phase of the Civil Rights Movement. A timeless & timely example of the genius of youth, the power of direct action & how history can move when people take collective action

The very white states of Iowa and NH have too great influence. But what 4 states should go first? How about these: the 2 states the Dem most narrowly won and the 2 the Dem most narrowly lost in the last presidential election. Call it “Swing State Tuesday.” With an open primary.

One of the most galling aspects of all this: There is no universe in which it should take 9 months to try to enforce the House's lawful subpoena of Don McGahn (& Bolton, etc.). That process should be fast tracked to take nine days.

Media: a good story to be reported: there must have been some extraordinary work done around the clock by staff for the House Managers to get them so well prepared. And good work done back nights at the WH as well. Nobody slept.

Before it fades into history, please note: the efforts to "out" the whistleblower is one of the despicable acts in our public life. It no longer matters who he/she is. The effect is to 1) put his/her life at risk & 2) to chill anyone who would dare expose Trump wrongdoing.

John Bolton should not do media interviews, as the media wants. He should testify, under oath, before the House Intelligence Committee. Next week. That has credibility.

I would be very interested in knowing if there have been any ties in non-presidential trials. If there were, I’d bet the VP voted to break the tie.

One thing is sure. CH Roberts has an extensive memo from his law clerks on the question of whether a presiding CJ can break a tie. It will conclude its an unresolved question. He will simply announce that the vote is 50-50 and the motion for witnesses fails.

The Q of whether the CJ can cast a tie breaking vote is difficult. I beleive because he stands in the shoes of the VP, he can. He won’t, a defensible decision. If he voted, he would vote for witnesses. WH has said they will make that chaos. So he will decline to vote.

Trump’s funding coercion was designed to help prevent Biden, then leading Trump in the polls, from getting the nomination by harming his reputation. That plan was stopped. But now it is achieving fruition on the floor of the Senate, as Biden’s name is being harmed on Iowa eve.

    3) The “sole power” to try rests with the Senate. The Q is whether the CJ steps into the shoes of the VP when presiding in place of the VP. If there is a tie, the CJ will have no way to avoid deciding whether the close Q of whether he can vote when the Senate is tied.

    2) CJ Chase broke two ties. Chase is thought to be too political. But his decision to break ties was not overruled by the Senate and are thus only precedent we have. The question is not easy.
