        I went to the clerk's office in person, asked for the citation & affidavit. Was told there was only citation. #mtcrime

        I think the point is for most people, there would be an arrest on the spot, and the aggressor would spend at least 1 night in jail pre-bond

        I get it and agree, but I think arresting him on the spot would have much worse consequences. We live in very partisan times.

        the sheriff contributed to his campaign. That is the only reason he wasn't arrested. And he should have been charged with felony assault

        I know that. I agree that this guy sucks, but in a majority of places choking someone and throwing them to the ground is not felonious.

        that's not true - in most places, assaulting someone and actually harming them is enough. Montana is more lax on assault than the norm
