I think the point is for most people, there would be an arrest on the spot, and the aggressor would spend at least 1 night in jail pre-bond

I get it and agree, but I think arresting him on the spot would have much worse consequences. We live in very partisan times.

I know that. I agree that this guy sucks, but in a majority of places choking someone and throwing them to the ground is not felonious.

that's not true - in most places, assaulting someone and actually harming them is enough. Montana is more lax on assault than the norm

all the clarification states is that it wasn't a strangle. She says he put his hands on either side of the neck.

The facts are moving around. Reminds me of Michael Brown's friend who lied a lot until confronted w/7 yrs in prison if he lied to the FBI.
