I saw that! Still waiting to see if the candidate will address it with supporters or press (who have now converged on Montana).

Did you make the copy yourself? If not then how do you know there is no affidavit?
-
I went to the clerk's office in person, asked for the citation & affidavit. Was told there was only citation.

I am confused. Wouldn't an altercation like this require some kind of jail time? Surely if this was anyone else that would be result?
-
It technically had a max of 6 months in prison.
-
I think the point is for most people, there would be an arrest on the spot, and the aggressor would spend at least 1 night in jail pre-bond
-
I get it and agree, but I think arresting him on the spot would have much worse consequences. We live in very partisan times.
-
the sheriff contributed to his campaign. That is the only reason he wasn't arrested. And he should have been charged with felony assault
-
I know that. I agree that this guy sucks, but in a majority of places choking someone and throwing them to the ground is not felonious.
-
that's not true - in most places, assaulting someone and actually harming them is enough. Montana is more lax on assault than the norm
-
You said that he should be charged with felony assault. This happened in Montana. You have to use Montana's laws... which say it's not.

Pathetic. And impotent. But not quite screeching as will happen soon enough and has on a regular nightly basis.

Why wasn't he charged with 45-5-202 "Using Force to Place the Victim in Fear" - or is picking someone up by their neck not legit fear?
-
all the clarification states is that it wasn't a strangle. She says he put his hands on either side of the neck.
-
The facts are moving around. Reminds me of Michael Brown's friend who lied a lot until confronted w/7 yrs in prison if he lied to the FBI.
-
Reminds me of Lewandowski, everyone thought he'd assaulted Fields until the hotel video came out & proved she & Shapiro were lying.
