Look, I feel that in any of these cases education and not state legislation is the answer. I thought this stemmed from a lifelong belief in reducing the power of the state but we've already established that I'm actually a transphobe so we can end this hell thread right here

well like... *arithmetically*, yes. but that's where you start getting into all the contortions of libertarianism. you can justify slavery in the South on states' rights, if you take that logic to its conclusion. state power is not actually a SUM of its power over individuals

one of the defining forms of state power is the declaration of states of exception. the state does not become less powerful when it chooses to *let people get away with things*.
