This is a grim but fascinating case study in collective action game theory. Those who opted out of the class-action lawsuit got way bigger compensations, but otoh, the class action included all of Tyndall’s patients, and paid out small amounts ($2500) to all.

So presumably the women who were both egregiously abused AND savvy about the situation opted out and went indie, while those who assessed they had weaker complaints or cases, or didn’t want the fight, stayed in. But looks like some just made a legal strategy error and regret it.
