I suspect most people who hold sacred holy cow views of contracts upon which they build elaborate political economy theory and "enforceability of contracts" have never actually wrangled messy real-world contracts, or bickered over buggy clauses written or arbitrated by humans.

I am not a contract lawyer, but have seen my share, and bickered over terms and stuff. If you think PHP is a messy language, contract law is like 10x PHP running on an "operating system" that's like 10x more cruddy than MS DOS. Not a good basis for religious views.

be careful! walk a little further down that path and you get into postmodernist gender nihilist property-is-theft/liberty/impossible territory!

Think of contracts as political platforms. The sanctity of contracts has upheld the Western way for a long time, & the West's greed will kill that sanctity off.

Westerners have been dissing themselves about "greed" for at least three thousand years (maybe five; bronze age ain't my thing.) Contracts were the solution, not the problem. Contracts were a *liberal* innovation. Not a reactionary one.

The law in the english speaker world sees reciprocity. The contract authors seek ir-reciprocity. The problem is not the law. it's the immorality and lack of trust of the participants. If it's important and ethical it's done on handshake. If it's not, it's done in contract.

It's this kind of experience that leaves me bewildered by the vision of DAO and Ethereum. I want them to be true, but there is no such thing as a complete contract.

TFW spending months trying to remove the worst things from a handset manufacturer’s “standard” contract, written for fixed price firmware dev, so we can use it for hourly rate dev. Hate it when they push us to take responsibility for all “intellectual property”.

And, more often than not, just copied from previous contracts and pasted into the new one without checking for consistency.
