“Open borders” is a not a hill to die on if you want humane borders. Recognize universal human right to global mobility aspirationally. Block movement by justified exception, permit by default. Crossing a border is not a crime. “Presumed gang-member rapist” is an insane axiom.

One of the things the pre-Westphalian world had that we don’t is de facto recognition of the universal human right to global mobility. Transport was primitive and it was a bloody and violent world with institutions like serfdom, but at least they didn’t need passports and visas

You have to be adrift in the oceans today to have legitimacy for your mere existence without paperwork. The only “public” spaces for being simply human are oceanic. Much as I like the aquatic ape hypothesis, that’s not an ideal condition.

I would rather say (if I really have to) that the state has a right to derogate - on special occasions - from the otherwise universal freedom of movement
