It's easy to check that the kernel is under GPL v2. https://lwn.net/Articles/200422/ … gives the declaration of opposition of most of the main kernel developers to v3, and Linus' antipathy is well-documented. Maybe. The case was not all that similar, though, and I guess the Linux Foundation can pay for highly powered lawyers and would back not jumping off the cliff.

My guess is that (i) the @LinuxFoundation is behind Linus' adoption of the #CoC and (ii) the right thing to be doing now is finding out what is going on. Lawyers will take account of what outcomes their clients want.
