It's actually not clear that they have the right to AFAIU (untested legal ground). But "should"? I think this is a really destructive course of action.
Maybe. The case was not all that similar, though, and I guess the Linux Foundation can pay for highly powered lawyers and would back not jumping off the cliff.

My guess is that (i) the
@LinuxFoundation is behind Linus' adoption of the#CoC and (ii) the right thing to be doing now is finding out what is going on. Lawyers will take account of what outcomes their clients want.
