Exactly. And the Steel Seizure precedent, Youngstown Sheet & Tube v. Sawyer, 343 U.S. 579 (1952), is universally accepted as binding constitutional law even in undoubted wartime emergencies.https://twitter.com/asharangappa_/status/1081383218325139456 …

And Truman learned that during an *actual* war, with an *actual* steel shortage, while there was an *actual* strike. And SCOTUS still benchslapped him.

I think that since Russia says it's at war with the US, when we impeach Donnie, we comfiscate all his golf courses and turn them into emergency housing for Vets and plants hemp to get rid of pesticides the grow food crops etc.

My concern is that was a different SCOTUS. The makeup of this SCOTUS right now, not just with majority conservatives, but with two of them appointed by trump, and one a firm believer in “absolute presidential powers” (paraphrasing probably) is what concerns me.

I know that case and company well. I don't agree w the summation that it was about preventing a strike, but I know he was barred from essentially nationalizing the steel operations due to a 'national emergency'. This case is very helpful going forward.

I think the wall would just be his excuse to gain emergency powers. He has a lot more going on than just the wall, and those emergency powers probably look enticing because of it. The scope of possibilities is breathtaking.

Several of the SCJ in 195w were appointed during FDR's administration. I would not bank on the same outcome with this court.

Trump doesn't give a fuck that building the wall is not actually possible. He just wants to use the wall issue to put congress Dems in a bind. He never brought it up when republicans controlled both houses.

Although I realize that you're citing precedent for the situation at hand, please remember that no one questioned Truman's allegiance to our nation. In normal times it would pass muster. The assumption that actors would play by the rules is long gone. We're in crazy territory!
