None of what the lawyer said justifies killing someone. Daniel Penny did not know Jordan Neely prior to this. Daniel Penny killed a man that was hungry and upset. Yelling about being hungry is not threatening nor is it a death sentence.

We would first like to express, on behalf of Daniel Penny, our condolences to those
 close to Mr. Neely. Mr. Neely had a documented history of violent and erratic behavior, the apparent result of ongoing and untreated mental illness. When Mr. Neely began aggressively threatening Daniel Penny and the other passengers, Daniel, with the help of others, acted to protect themselves, until help arrived. Daniel never intended to harm Mr. Neely and could not have foreseen his untimely death.
 For too long, those suffering from mental illness have been treated with indifference. We hope that out of this awful tragedy will come a new commitment by our elected officials to address the mental health crisis on our streets and subways.

So here violence is being justified in the name of protecting the working class, as though the increasingly precarious NYC working class don’t have more in common with a homeless person sleeping in the subway than the wealthy people the police exist to protect

We don't know enough to judge what happened to Jordan Neely, but lots of people who don't live in New York and lots of people who don't ride the subway have a lot of opinions on this and they need to take a seat. It's working class New Yorkers who have to face down this violence.

I ride the subway a lot. Not a week goes by that a mentally ill person doesn't get on and terrorize the entire car—especially women, especially Asians. Usually the men just sit there and pretend it's not happening. It's a disgrace that working New Yorkers have to live like this.
