Fixing up an old kernel so it looks like a new one is a pretty significant set of hoops to jump through (and you're going to have to automatically deal with kernel updates)
can't you load the old kernel, let a custom init exploit it, and then use the kernel as bootloader to load a patched version of the current kernel? kexec exists, so that has to be possible, right?
and it's not like you need kernel code exec to implement a rootkit anyway
