Neal, you’re a good friend, but you know first-hand that the Deputy SG (career or not) speaks on behalf of the Administration. And (as you admit) the Obama Admin’s position was, as Stewart argued, “WE COULD PROHIBIT the publication of the book using the corporate treasury funds.”

Kagan's statement was later and not offered in the heat of an arg in response to a stray Q. It's just wrong to say this was the argument of the Obama Admin in Citizens United. Just as it's 100% wrong to insinuate that the Ct is a "vote away" from removing the Mojave Cross, 2/3
