The problem with that are users might then incorrectly believe https means not phishing & makes CAs arbiters (ugh)
I'm really sold on @fugueish's solution here: make https neutral...I think that solves everyone's concerns.

I don't think anybody claims that. I think @ericlaw claims users might incorrectly assume that.
