That would be one way, sure. I mean, an attacker could get themselves the firmware blob the FBI wanted by only compromising infrastructure that exists today.

All systems can be compromised for sure but the thesis that these systems are generally online and remotely compromisable today (especially with firmware which is what we are primarily discussing) is false.
