It doesn't need to be in navigation mode to report your position and speed though.

If you start google maps car navigation mode it thinks you are in a car no matter what you are actually doing
GPS location on phones accurate to ~10m. That's v. roughly length of a bus. Google could analyse count of signals from one location and estimate if > typical bus capacity (which wld prob detect this cart of phones) but who knows if they've implemented that heuristic yet?
