    one way to combine the two is to formally recognize political parties as part of the constitutional order - Kelsen argued for this and Germany does it - although this arguably then also cartelizes the parties and so reduces their mixed-regime aspect

    this is in pretty strong contrast to the ancient ideal of the mixed regime, where for example in Rome you had different bodies that were constitutionally connected to different classes - plebian, aristocratic, etc
