The problem wasn't that he went to the Maw, but that he was denied judgment.
Given what he did till the end of warcrfat 3 before he became the lich king it was crystal clear what he deserved.

Anything he did before picking up Frostmourne was not deserving of the Maw. And not beyond redemption. Especially given what other characters are in the other zones of the Shadowlands. Garrosh, Kaelthas...
