      As a basic rule, any article that describes "open sourcing patents" is one that can be disregarded, as it is terribly confused.

      As are most articles on this matter. However, they were clearly told that there were some exceptions to this relationship, specifically with regard to Windows, and I’m wondering if they lack the background to convey this adequately.

      I haven't heard of any meaningful exceptions, relating to Windows or anything else, and as I say, OIN says that Microsoft signed the standard agreement, not the limited one.

      As far as I can tell, this only binds them to the patents which they contributed to OIN and isn't an umbrella over their entire patent portfolio.

      Wrong. As a defensive patent aggregate for Linux, it only covers patents pertaining to making, having made, using, importing, and Distributing any Linux System. Their standard agreement does not include patents pertaining to Windows, at all.

      No. It explicitly covers every single Microsoft-held patent. Should any one of those patents be found to read on any part of the Linux System then that usage is licensed without royalty or other obligation.

      Is this based on actual confirmation from Microsoft or your own interpretation of the license? Because nothing in this license can encompass what you are implying from what I can tell. They’re scoped specifically to Linux.

      Instead, it appears to be limited to the patents relevant to Linux, which Microsoft appears to own a lot of. They’ve caught a lot of flak for joining the Linux foundation and buying github while enforcing their Linux related patents; which I presume are among the 60k to OIN.

          I say this because it comes down to their revolving definition of Linux System.
