I think our current system very fluid. He is tried in court by a JUDGE who considers deontology (what rule was broken) VIRTUE ethics, did he mean to steal it etc. He then looks at history, CONTEXT (he was starving) and reasons out the verdict/punishment for his particular case

Good take, though in practice judges tend to gravitate towards static rules of thumb. I'd still say the system as a whole is mostly well, systemic, save for judges having leeway and cops deciding to let you off without a ticket.
