like even if this guy is literally saying "now, I'm not a licensed therapist, but…", if he's functionally acting in the capacity of a therapist without a license, surely that's against some law

They're much more loosey goosey about this for therapists than for, like, lawyers or medical doctors As long as you don't actually use the word "therapy" or "psychiatric treatment" or anything like that it's anything goes

Unfortunately extremely accurate Also a fun thing is that sometimes people who get their therapy license stripped can continue functionally practicing under these kinds of loopholes.

Dr Phil is literally prohibited from acting as a therapist after ethics violations Like it's way more serious for him to be illegally practicing than for someone who's just not a therapist (just like the ABA is way more hardcore about policing the actions of disbarred lawyers)

It's this bizarre paradox where if he WERE licensed and doing this as part of "clinical practice" THIS WOULD BE A REASON TO TAKE AWAY HIS LICENSE Because putting the therapeutic process on display for an audience as "entertainment" is FUNDAMENTALLY UNETHICAL

But because he ALREADY lost his license long ago for other unethical shit he did, he can just go ahead and have his show now with nothing to lose He can't be turning actual therapy into a TV show because he's NOT doing actual therapy - because he is legally barred from doing so

I believe they have changed it now but as recently as the 90s in Idaho even if you were stripped of your license you could still practice therapy as long as you didn't officially call yourself a therapist. I know that was a while ago but NOT THAT LONG ffs.
