Once upon a time, I took a meeting at Sun. The person there was keen to tell me that Sun owned "JavaScript", but that they'd never do anything evil with it. Life comes at you fast.https://twitter.com/benschwarz/status/986712202991169537 …

To whom? They did a tm license to Netscape but I don't recall anything they committed to from their side. They just let Netscape use "JavaScript" (not "Java").

Tons of books and even products use "JavaScript" without a license. The last time I looked at http://uspto.gov filings, Oracle was using jQuery how-to docs as proof it was defending the mark. Seems contestable.

I spoke to my IP attorney (neighbor who practices gives me his NY state pro bono obligation), and he's going to outline a case for me, based on "Naked Licensing" and "Failure to Police".
