  5. The FBI agents are getting most of the grief for what they did -- the errors identified by the IG -- but those don't happen in a vacuum. Decision-making happens against the backdrop of "guidance" or outright "instruction". 5/

  6. And you see a good example from the guy who was the younger agent saying "We had to get and AUSA interested because without an AUSA the case is going nowhere." My point in that regard is to highlight the very strong likelihood that the SC lawyers drove the train on CH. 4/

  7. It shows a good example of how two case agents work in conjunction with their squad supervisor to plan and make critical decisions early on that could either sink the case or advance it--because the early decisions are made without much real information, and a lot of questions.3/

  8. I'd like for people whose only view of the FBI comes from the CH investigation to watch and see that in MOST instances, the beginning can be methodical and carefully planned out, especially when the crime appears to be ongoing. 2/

    If Biden craters tonight, the Dems might pat themselves on the back for the unintended benefit of impeachment. Even with Warren/Sanders/Klobuchar stuck in DC, Biden slipped in the polls. And the blowback from Hunter/Burisma may be fatal. They may have saved themsevles.

    The way to avoid this is to limit the Senate trial to the witnesses and evidence the House generates. The point was made over and over that the House managers claimed they had an "overwhelming" case. If that wasn't the fact, then they should have done more work in the House.

    That would make the Cong. Impeachment Power plenary over all powers and privileges of the Exec. Br., and immune from scrutiny by the Judicial Br. There would be no "check" on the Impeachment Power, and peaceful transitions of power via elections could be supplanted by removals.

    Then ship it over to the Senate, with a demand that the Senate dig out further information with subpoenas and witnesses as part of the trial process demand compliance by the Exec. Branch will all demands on the basis that Exec. Priv. doesn't apply to the Impeachment Power.

    Any policy dispute that agitated the House majority sufficiently could be ginned up into a quick and dirty process to pass one or more articles of impeachment, using various words and phrases until one or more seemed to gain traction, and then passing it in partisan fashion.

    The reference was a fear that the process followed in the House, and then shipped over to the Senate with a call for more witness testimony and a claim that EP violates the Cong. Power of Impeachment, would become the "new normal" when the House and POTUS of different parties.
