If it happened in Virginia, likely no, as it would probably only be prosecuted as misdemeanor assault, which has a 1 year statute of limitations. I know Nina and Joe and I don't think they'd make a reach for a felony charge here.

That said, @zdroberts, I for one really hope you gather witnesses, file a police report, and lobby the police and prosecutor's office to charge this guy.
